§ 1 About the Privacy Policy

By using the services of WOBAK 1 GmbH (WOBAK), you entrust your personal data to WOBAK. As a basis for exercising your rights, we inform your in this privacy policy (WOBAK Privacy Policy Website), what types of personal data WOBAK collects, why WOBAK collets such data and what WOBAK uses such data for.

WOBAK collects, processes and uses your personal data in accordance with the provisions of the German Telemedia Act (Telemediengesetz: TMG), the German Federal Data Protection Act (Bundesdatenschutzgesetz: BDSG) and other applicable legislation for the protection of the right to privacy and personal integrity, including any other legislation implemented under Directive 95/46/EC of the European Parliament and of the Council of 24 October 1995 on the protection of individuals with regard to the processing of personal data and on the free movement of such data.

§ 2 Service Provider

WOBAK acts as service provider (Dienstanbieter) pursuant to §§ 2 sentence 1 no. 1, 13 TMG and as a data controller (vertrauliche Stelle) pursuant to § 3 para. 7 BDSG, with the contact details set out in § 13.

§ 3 Personal Data Collected by WOBAK

Personal data means any information concerning the personal or material circumstances of an identified or identifiable natural person.

The personenal data, which WOBAK may process or use will be directly or indirectly provided by you to WOBAK, e.g. in connection with the registration of your user account by WOBAK, in connection with using the mobile phone application (the App), the website of WOBAK / worklean (the Website) or any other services provided by WOBAK or when you contact WOBAK (together, the WOBAK Services). Such personal data are collected by WOBAK to provide the WOBAK Services and comprise, e.g. the following categories:

Contact data: When registering your WOBAK user account and/or using the WOBAK Services, WOBAK will collect personal data for identification purposes, such as your first name and surname, address, personal password (encrypted), e-mail address, mobile phone number and other data you provide in connection with WOBAK Services, which you would like to use or acquire.

Payment data: When registering your WOBAK user account, you will be asked to provide certain payment data depending on the payment method selected by you and approved by WOBAK, e.g. credit card information.

Data on the use of the data rooms: In case of entering worklean, the virtual platform of WOBAK for the purposes of virtual collaboration in the cloud, the following personal data will be collected:

  • IP-address,
  • date and time of the request,
  • time difference to the local time of Greenwich Mean Time (GMT),
  • content of the request (specific page requested),
  • access code/ HTTP-Statuscode,
  • the respect amount of data transferred,
  • website, from which the request comes,
  • browser,
  • operating system and its and its interface,
  • language and version of the browser software,
  • the ID of the data room the user has entered into,
  • time and duration of the visit of the data room (online status),
  • documents which have been opened,
  • documents which have been downloaded,
  • time of the actions taken in the data room,
  • time of the last visit of a card in a data room.

If you are using the Website for information purposes only, i.e. if you do not sign in, register or otherwise transfer data to use the WOBAK Services on the Website, WOBAK will not collect personal data, except for data which are transferred by your browser in order to facilitate the visit of the Website. These data are:

  • IP-address,

§ 4 Anonymous / Pseudonymous Use

Pursuant to § 13 para. 6, sentence 1 TMG, you may choose to use the Website and to process payments in an anonymised manner or using a pseudonym, e.g. a user name. this applies only to the extent that an anonymous or pseudonymous use of the Website or the payment process is technically possible and reasonable. If you use a pseudonym certain functions of the WOBAK Services, which are based on the verification of the identity will not be available.

§ 5 Purpose of Collecting, Processing and Using of Data.

WOBAK collects, processes and uses your personal data in order to offer, maintain, improve and manage the WOBAK Services and to provide an adequate customer service.

WOBAK also collects, processes and uses personal data to comply with its statutory duties or legal requirements or to comply with public authority orders.

WOBAK may also collect, process and use your personal data in order to assist you when registering your user account and to provide you with further information about the WOBAK Services, e.g. in case your registration process has been aborted because of an interruption.

§ 6 Transfer of Personal Data to Third Parties

WOBAK may transfer your personal data to third parties for the purposes set out under § 5 above, observing the WOBAK Privacy Policy Website and in compliance with the statutory provisions.

Your personal data will be processed in a computing center of Claranet GmbH, Frankfurt am Main in Germany. WOBAK ensures that sufficient technical and organisational measures for the protection of such personal data are in place.

Intercom

Your first name and your surname and your e-mail address and, if applicable, your IP-address will be transferred regularly for statistic purposes to the following service provider:

Purpose of the transfer is to improve our services and to make your support requests faster and more efficient. Intercom, Inc. is part of the “safe harbour” programm, which endeavours to achieve a better privacy policy for companies which do not have their corporate seat in the EU. Mailjet

The sending of e-mails to various user groups of worklean is a central function of this platform. This ensures that content is communicated timely and personally. For organising the sending of e-mails we use the e-mail sending service of Mailjet, 37 Bis Rue du Sentier 75002 Paris, France. This involves the transfer and temporary storage of the e-mail addresses needed for effecting the mailing of the e-mails. Each e-mail address will be completely deleted 30 days after the date an e-mail has been send to it via Mailjet. The e-mails addresses will only be used in connection with worklean and will not be transferred to third parties.

Viral Loops

In addition, we will send regularly your first name, surname, your e-mail address and, where appropriate, your IP-address for statistical purposes to the following service provider:

For sending e-mails to persons interested to participate in the beta phase of Worklean we are using the e-mail despatch service Viral Loops. Only the e-mail addresses, names and browser information necessary for the sending of the e-mails will be transferred and will be stored temporarily with Viral Loops. E-mail addresses will be used exclusively in connection with Worklean and will not be transferred to third parties.

If you have booked chargeable services, payment data may be transferred to the relevant payment service providers for the execution of the payment process, depending on the payment method selected by you and approved by WOBAK. In this case, the payment services provider is responsible for your payment data.

Where „direct debit“ is the selected payment method, the account details will be collected, stored and transferred by WOBAK, together with the payment amount owed, to Nassauische Sparkasse, Wiesbaden, Germany.

Where “PayPal” is the selected payment method the payment amounts owed will be transferred to PayPal (Europe) S.à r.l et CIe, S.C.A. in Luxemburg.

§ 7 Right of Information

You have the right at any time to request information free of charge regarding your personal data stored with WOBAK as well as their origin, recipients or categories of recipients to whom the data are transferred and the purpose for which they are stored, collected or used.

§ 8 Right to Correction Blocking and Erasure

You have the right to have date corrected, blocked or erased in case the personal data stored with WOBAK should be incomplete or inaccurate or processed other than for the purposes stated in § 5 or in breach of the BDSG or any other provisions of applicable law.

§ 9 Right ot Revoke a Consent

If you have given your consent for the use of data, you may revoke such consent at any time with future effect.

§ 10 Data Security

WOBAK takes the protection of your personal data very seriously. To the extent WOBAK collects, processes or uses personal data, this will be done on servers located inside the EU.

When storing your personal data, WOBAK takes all necessary and appropriate technical and organisational measures to protect you personal data from unauthorised access, modification or destruction. Such measures will be adjusted in line with the state of art.

Access to data will be strictly limited by various methods. The identification of the Test Users occurs pursuant to a password request. The passwords will be filed and compared pursuant to PBKDF2 (HMAC SHA-256). All the data will stored and processed in a secure data center in Germany which has been certified in accordance with ISO/IEC 27001:2013 (secure management of information) and ISO/IEC 27018:2014 (privacy policy).  In addition, the administrative access to the infrastructure is secured by a firewall and can only occur via VPN. All the data will be stored in blocks, distributed on several hard drives. Hence the reconstruction of data by reference to single hard drives will not be possible.

§ 11 Cookies

WOBAK uses so-called Cookies in ordert to optimise the services of WOBAK, for statistical evaluations and for analysis. Cookies are small text files, which are stored on your computer or your mobile phone which allow the identification of your computer or your mobile phone. Cookies enable WOBAK to adapt their website to your needs as a customer of WOBAK Services.

There are two types of cookies: session-cookies and permanent cookies. A session-cookie will be automatically deleted as soon as the website has been closed. A permanent cookie will be stored for a certain period of time on your computer or mobile phone. Both types of cookies can be placed on your website by different providers (so-called first-party or third-party providers) to store them on storage media (such as the hard disk of your computer). A first-party-cookie will be placed by the provider on the website which you are visiting. A third-party-cookie will be placed by a third-party provider, which is operating the website you are visiting.

If you do not agree to the storage of cookies on your computer or mobile phone, you may adjust the settings of your web-browser on your computer or mobile phone under „Settings“ and delete any cookies which have been placed on your storage media. Most of the web-browsers accept cookies automatically. However, there is the possibility that the web-browser does not accept cookies or a warning is placed on the screen before the cookies are stored. If you do not accept cookies this may adversely impact on the functionality of the website or other WOBAK Services.

WOBAK uses session cookies. The cookies are used to identify the user downloading the available content and to request transitory cryptografic access tokens (JSON Web Token). Further intercom (see § 6) uses session cookies to assign request to the users of WOBAK. Any such cookie is only valid for the domains ending *.worklean.com.

The stored data will be stored separately from other data stored at WOBAK. In particular the data of the cookies will not be linked to the further data stored.

§ 12 Amendments to the WOBAK Privacy Policy Website

WOBAK reserves the right to amend the WOBAK Privacy Policy Website from time to time. If any amendments are made to the WOBAK Privacy Policy Website which implement a modification of the way WOBAK collects, processes or uses your personal data, WOBAK will notify you of any such amendments, e.g. via the website or by e-mail.

Should you continue to use the WOBAK Services after having been notified of such amendments, you are deemed to have accepted the amendments. WOBAK recommends that you regularly read the WOBAK Privacy Policy Website for the most recent information on how WOBAK collects, processes and uses your personal data.
